This Customer Service Terms and Conditions Agreement ("Agreement") governs all the terms and conditions associated with a Customer's ("Customer", "you", "user" or "end user") use of the communications or hosting services and any related products or services ("Service") offered by or through Entirnet ("we", "us", "our", "entirnet", "entirnet.com").
If you visit or shop at our website or any other affiliated websites, you affirmatively accept the following conditions. Continued use of the site constitutes the affirmative agreement to these terms and conditions.
Entirnet reserves the right to change the terms, conditions and notices under which the Entirnet sites and services are offered, including but not limited to the charges associated with the use of the Entirnet sites and services.
1. Online Acceptance
1.1. Since signing up for Entirnet services is an online transaction, it is understood between Entirnet and the Customer that online acceptance of this Agreement will carry the same legal authorization as if the Customer is providing a handwritten signature of acceptance.
1.2. When you visit Entirnet's websites or send Email to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by Email or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
2.1. All content on this site, such as text, graphics, logos, button icons, images, data compilations and software, is the property of Entirnet and is protected by international copyright laws. The compilation of all content on this site is the exclusive property of Entirnet and is protected by international copyright laws. All software used on this site is the property of Entirnet and is protected by international copyright laws.
3. Limitations and Prohibitions
3.1. Entirnet shall not be held liable for any delay or failure to provide service(s) at any time. In no event shall Entirnet, its officers, Directors, Employees, Shareholders, Affiliates, Agents or Providers who furnishes services to customer in connection with this agreement or the service be liable for any direct, incident, indirect, special, punitive, exemplary or consequential damages, including but not limited to loss of data, lost of revenue, profits or anticipated profits, or damages arising out of or in connection to the use or inability to use the service. The limitations set forth herein apply to the claimed founded in Breach of Contract, Breach of Warranty, Product Liability, Tort and any and all other liability and apply whether or not Entirnet was informed of the likely hood of any particular type of damage.
3.2. Entirnet makes no warranties of any kind, written or implied, to the service in which it provides.
3.3. Entirnet services are not intended for use as a primary telephone source for business or residential users.
3.4. Entirnet does not allow calls originating from Payphones to toll free numbers on its network.
3.5. You agree that our services do not include 911/e911 or any emergency calls, therefore you accept to comply your local regulations regarding this matter. Entirnet shall not be held responsible or liable if the Customer does not comply 911/e911 or any emergency calls local regulations.
3.6. The Customer is prohibited from using the Service for callback calls, auto-dialing, continuous or extensive call forwarding, telemarketing (including, without limitation, charitable or political solicitation or polling), fax or voicemail broadcasting or fax or voicemail blasting purposes.
3.7. At Entirnet's sole discretion, you may incur a port away fee for any DID number(s) leaving Entirnet's network as this is a pass-through charge from Entirnet's underlying carrier(s).
3.8 When using Services, the Customer is prohibited to carry out any actions opposing applied legal acts, good morality or violating rights of third parties.
4. Payments and Rates
4.1. Due to the nature of this industry and high credit card fraud rate, Entirnet reserves the right to request the following documentation for verification purposes; A copy of the credit card used to establish the account along with valid photo identification such as a Passort, Drivers License or other Government issued identification.
4.2. We do not offer prepaid services of any kind. We offer instead flat-rate plans and all the charges will be billed as a re-occurring monthly service fee charged to Customers credit card/debit card or from positive account balance. You agree to inform cancellation of flat-rate plans renewals at least 5 days before its renewal. If not, the renewal charge may also be billed one last time.
4.3. All our sales are final. That means that no refunds will be given, including but not limited to getting money back, changing type of service or any type credit refunds.
5. Governing law and jurisdiction
5.1. This Agreement shall be governed by the laws of the United States of America without reference to its principles of conflict of laws.
5.2. The Parties irrevocably consent and submit to personal jurisdiction in the commercial courts of New York for all matters arising under the Agreement.
6.1. Violation of any state or federal laws or laws for any other competent jurisdiction may result in immediate account termination and/or disconnection of the offending service.
6.2. Entirnet reserves the right to terminate service at any time with or without notice; especially if Customer is found to be in violation of Entirnet's Terms & Conditions. You agree that Entirnet shall not be liable to you or to any third party for any modification, suspension or discontinuance of service.
6.3. The Customer agrees to indemnify Entirnet against any cost and/or damage and/or expense and/or claim and/or demand, including any made by a third party, arising out of the Customer's or End User's violation of Terms & Conditions.
7. Product Configuration
7.1. Entirnet has no obligation to offer technical assistance for third party devices. This includes PBX Servers/Switches, IP Phones and ATA Adapters.
7.2. We do provide sample configuration for Asterisk/Trixbox servers, Linksys PAP2/Sipura Devices and standard SIP settings for use with IP Phones/Softphones which is easily accessible on the support page within our portal. The sample configuration provided will not assist with internal routing, extension logic or calling plans. It is the end users responsibility to properly configure their servers and or devices for use with Entirnet services.
8. Site Policies, Modification & Severability
8.1. We reserve the right to make changes to our site, policies, and these Terms & Conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
9. General Complaints
9.1. Please send reports of activity in violation of these Terms & Conditions to our Support. Entirnet will reasonably investigate incidents involving such violations. Entirnet may involve and will cooperate with law enforcement officials if any criminal activity is suspected. Violations may involve criminal and civil liability.
This privacy notice discloses the privacy practices for entirnet.com and its language subdomains. This privacy notice applies solely to information collected by this Entirnet website. It will notify you of the following:
- What personally identifiable information is collected from you through the Entirnet website, how it is used and with whom it may be shared.
- What choices are available to you regarding the use of your data.

- How you can correct any inaccuracies in the information.

Entirnet are the sole owners of the information collected on this site. Entirnet only has access to/collect information that you voluntarily give us via email or other direct contact from you.

Entirnet take precautions to protect your information. When you submit sensitive information via the Entirnet website, your information is protected both online and offline.
Wherever Entirnet collects sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way.
While Entirnet uses encryption to protect sensitive information transmitted online, Entirnet will also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which Entirnet stores personally identifiable information are kept in a secure PCI-compliant environment.
